First and foremost, not every couple is a good candidate for mediation, and choosing mediation does not automatically mean that your divorce will be less contentious than others. Being able to trust your spouse throughout the process, as well as the process itself, is a must when beginning to consider mediation. Please be advised that only limited protections are available with mediation, and financial and life circumstances can still change during it, which can affect the mediation. Therefore, if one party has any reason to delay the proceedings, the process can be dragged on for years. And if mediation fails, you’ll have to start the entire divorce process over again.


But for the right couple, mediation can offer many benefits, including flexibility and a way to keep private matters out of the public record, which they would become if the case were to go to court. A combination of mediation and litigation can be used as well in cases where both spouses are on the same page with most issues except a few. You may also opt for represented mediation. This is when both spouses seek divorce through mediation, but each retains their own separate legal counsel.
